Property & Casualty Insolvencies

What happens during Property & Casualty Insolvencies?

Receivers generally send written communication to all in-force policyholders and claimants with information and key dates associated with the liquidation including bar date (deadline for filing claims), and the policy termination date, generally 15-30 days post liquidation date giving policyholders a window to secure replacement coverage.

Policyholder Claim Scenarios

icon-1

Policyholder has an open claim on file with the insurer prior to liquidation.

In this situation, you should have received an acknowledgement and an assigned claim number from the insurer.

The receiver will send a written communication to all parties with an open claim about the insolvency with key dates and contact information.

Issue occurred after liquidation date, and before the policy termination date.

Once an insurer is placed in liquidation, property & casualty policies are terminated generally in a 15 to 30 day window of time.

The policyholder should immediately report the claim to the Receiver, which may require a formal proof of claim (POC) be filed with the receivership estate before the bar date.

Note, a proof of claim may be made for an exposure believed to be covered under the policy, but a specific claim has not yet been presented.

Policyholders must submit the claim to the Receivership estate and obtain recognition as timely filed to receive coverage via the Fund.

Claimant Against Policyholder Scenarios:

Issue occurred after the liquidation date, and before the policy termination date.

Once an insurer is placed in liquidation, property & casualty policies are terminated generally in a 15 to 30 day window of time.

The claimant should immediately serve notice to the policyholder and the Receivership estate of their loss and seek compensation under the policy. Timely action is encouraged as the bar date affects coverage limits, governed by WI Statute 646.

In situations where the policy coverage is above $500,000 the claimant should contact the Receivership Estate to determine whether they proceed in filing a proof of claim in the liquidation estate.

A claim is presented after the bar date.

Claimants must submit the claim to the policyholder and the Receivership estate and obtain recognition as timely filed to receive coverage via the Fund.

In all scenarios, policy and claim data is directly transferred to the Security Fund on policies for which we will be providing coverage.

Upon receipt of the data and information, the Security Fund sends letters of introduction to policyholders and/or claimants outlining the path forward with claims adjuster contact information.
